01Preamble

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between In a Box Sàrl, a limited liability company under Swiss law, operating the website easycondom.ch (hereinafter "easycondom", "we" or "our"), and any person making a purchase on the website (hereinafter the "Client" or "you").

By placing an order, the Client acknowledges having read these GTC and expressly declares to accept them without reservation. The applicable GTC are those in force on the date of the order.

easycondom reserves the right to modify the GTC at any time. Modifications come into effect upon their publication on the website and do not apply to orders already placed.

02Seller's Identity

03Discretion & Confidentiality

We make it a point of honour to ensure your orders are delivered 100% discreetly. Specifically:

• Neutral packaging: cardboard box or envelope with no mention of easycondom.ch or its contents.
• Sender: only "In a Box Sàrl" appears on the label.
• Delivery note: not visible from outside the package.
• Personal data: treated confidentially, never passed on to third parties for commercial purposes without your explicit consent (see our Privacy Policy).
• Postal address: used solely for delivery, never for external advertising.

04Ordering

The order is firm as soon as you click the "Place Order" button on the confirmation page. At this moment, you make us an offer to purchase the selected products. We reserve the right to accept or refuse this offer.

The sales contract is concluded when you receive an email confirming that your order has been moved to "Processing" or "Shipped" status. This email constitutes the official confirmation.

In a Box Sàrl reserves the right to cancel any order from a Client with whom there is a dispute relating to the payment of a previous order.

In the event of an error in the delivery details, In a Box Sàrl cannot be held responsible for the impossibility of delivering the ordered products.

Vouchers, promo codes, and other discounts are not cumulative, unless explicitly stated otherwise.

05Payment Methods

For your security, we offer the following payment methods. All transactions are encrypted, and we never have access to your banking details.

Credit & Debit Cards

Visa, Mastercard, American Express. Payment is processed by Shopify Payments / Stripe. For your discretion, the statement descriptor will be "In a Box Sàrl".

TWINT — Switzerland only

TWINT is the Swiss digital wallet, usable from your smartphone (iOS / Android). No card required, instant payment from your postal or bank account.

PostFinance Card / E-Finance — Switzerland only

Pay for your order directly with your PostFinance account. The debit occurs upon shipment.

PayPal

Secure payment via PayPal. For your discretion, the statement descriptor will be "PAYPAL* INABOX SARL".

Apple Pay / Google Pay

Express one-click payment, via Touch ID, Face ID or fingerprint. Secured by end-to-end encryption.

Bank Transfer — Switzerland only

Transfer the amount to our account. Your order will be shipped upon receipt of payment (within 1-3 business days).

Please include the order number in the communication. Any order not paid within 30 days will be automatically cancelled.

06Prices & VAT

All prices displayed on easycondom.ch are in Swiss Francs (CHF), including 8.1% Swiss VAT (rate in force since January 1, 2024).

The invoiced price is that shown on the order confirmation, regardless of any variations between the order date and the delivery date.

In the event of a clear pricing error, In a Box Sàrl reserves the right to modify the price and offer the Client either the new price or the cancellation of their order without charge.

07Shipping Costs

easycondom ships only to Switzerland and Liechtenstein.

Standard delivery free from CHF 40

Delivery is free for all orders from CHF 40 (VAT included).

Delivery below CHF 40

For orders under CHF 40, a flat shipping fee of CHF 6.90 applies. These fees cover preparation, discreet packaging, and dispatch by Swiss Post as priority parcel.

Express delivery

A Swiss-Express "Lune" delivery by Swiss Post is available for an additional charge. Your parcel is delivered the day after dispatch before 9 am, from Tuesday to Saturday.

Outside Switzerland / Liechtenstein

Orders with a delivery address outside Switzerland or Liechtenstein are not accepted. For international shipments, please consult our partner site kisskiss.ch.

08Delivery Times

For in-stock products:

• Orders placed Monday to Thursday before 5 pm: delivery within 24 hours (next business day).
• Orders placed Thursday 5 pm to Friday 5 pm: delivery the following Monday (Priority Post) or Saturday morning (Swiss-Express).
• Orders placed Friday 5 pm to Sunday: processed on Monday, delivered from Tuesday.

In a Box Sàrl cannot be held responsible for any delay resulting from an error or delay by the delivery service provider (Swiss Post). Such a delay does not entitle you to any compensation, refund, or free cancellation.

09Warehouse Pickup

You have the option to collect your order for free from our warehouse in Sion. Simply select "Warehouse Pickup" when choosing your delivery method.

10Product Conformity

The images, photographs, and descriptions of the products offered on easycondom.ch are not contractually binding: they are provided for informational purposes only. If errors or inaccuracies have been introduced, In a Box Sàrl cannot be held liable.

Depending on screen settings, product colours may differ slightly from the actual products. Technical information and external links are provided for informational purposes only. Technical specifications and the content of delivered products may differ from the data provided by manufacturers.

All condoms sold are CE certified and comply with ISO 4074. Lubricants and cosmetic products comply with the European Cosmetics Regulation.

11Damage & Delivery Errors

Any transport damage (damaged package, forced opening) must be reported immediately to the carrier upon delivery, failing which the Client assumes responsibility for any damage.

Any goods delivered by mistake or in a quantity greater than ordered must be returned without delay, or at the latest within 7 days. Otherwise, the excess goods will be invoiced at the usual selling price.

Any missing goods must be reported to us within 7 days of delivery.

12Returns

For any return (delivery error, defective product, withdrawal), a return request is mandatory. Please send it by email to info@easycondom.ch, stating your order number.

Defective and warranted products will be replaced with a new, identical product. If the product is no longer available, a credit note or an equivalent replacement product will be offered.

Return shipping costs are, in all cases, borne by the Client (unless the error was ours).

13Right of Withdrawal

In accordance with Swiss commercial practice, In a Box Sàrl grants a withdrawal period of 14 calendar days from the delivery of the products.

To exercise this right, products must be:

• Undamaged
• Unopened
• In their original packaging, with control labels intact (not peeled off, torn, or cut)

For any return or cancellation, administrative fees of 10% of the selling price of the returned product(s) apply. Initial shipping costs and return costs remain the responsibility of the Client.

In the event of a return of an order that benefited from a free gift, the gift must also be returned new and unopened if the final amount after return would not have qualified for it. Otherwise, the gift will be invoiced at its usual selling price.

14Warranty

Products are covered by the legal warranty of the Swiss Code of Obligations (Art. 197 et seq. CO) for non-conformity defects.

Electrical or electronic products (including certain stimulators and accessories) benefit from a 2-year manufacturer's warranty from the date of delivery. Consumable products (condoms, lubricants, tests, hygiene products) are not covered by a specific warranty beyond the legal warranty.

In the event of repair or exchange of a defective product, no extension or renewal of the warranty period is granted.

To claim a warranty, contact info@easycondom.ch with your order number and a description of the defect.

15Retention of Title

In accordance with Article 715 of the Swiss Civil Code, In a Box Sàrl remains the owner of all delivered goods until full payment of the corresponding invoice.

16Limitation of Liability

These GTC define all our obligations and responsibilities towards the Client.

We are not bound by any other warranty, condition, or provision, except those expressly mentioned herein. Any warranty, obligation, or provision concerning the products or services that could be implied or incorporated by law, jurisprudence, or otherwise (including any implied condition as to quality, fitness for a particular purpose, or any duty of care) is expressly excluded by these presents.

In particular, In a Box Sàrl does not guarantee that the products are suitable for the specific use expected by the Client.

Our liability cannot be engaged for any loss of income, loss of profits, loss of contracts, loss of data, nor for any indirect or consequential loss or damage, of any kind whatsoever, resulting from or caused by a harmful act (including negligence), breach of contract, or otherwise.

Our total liability, contractual or otherwise (including in case of negligence) can in no case exceed the amount paid by the Client for the products or services in question.

In a Box Sàrl cannot be held responsible for damages, material, immaterial, or bodily, resulting from a malfunction or improper use of the products sold. The same applies to any modifications of the products by the manufacturers.

We cannot be held responsible for any delay or failure to fulfil our obligations due to circumstances beyond our control (force majeure: strike, disaster, major carrier failure, etc.). In case of delay, we will fulfil our obligations as soon as possible.

17Data Protection

The protection of your personal data is governed by the nLPD (new Swiss Federal Data Protection Act, in force since September 1, 2023). For details on processing, retention periods, access rights, and legal bases, please consult our Privacy Policy and our Cookie Policy.

18Disputes & Applicable Law

These GTC are subject to Swiss law, excluding conflict of law rules and the Vienna Convention on the International Sale of Goods (CISG).

In the event of a dispute, the parties will first endeavour to find an amicable solution. For consumer Clients, the Swiss Commercial Ombudsman can be contacted (ombudscom.ch).

Failing an amicable resolution, the competent courts are those of the registered office of In a Box Sàrl (Lens, Valais), although In a Box Sàrl reserves the right to refer the matter to any other competent court under Swiss law.

19Final Provisions

If any provision of these GTC is deemed null or unenforceable, the other provisions shall remain in full force and effect.

For all cases not governed by these GTC, the Swiss Code of Obligations (CO) and applicable federal laws apply.

These GTC are written in French. In case of translation into another language, only the French version shall prevail in case of dispute.
